DISCLAIMER
I, the Client, agree that prior to having
Above & Beyond IT, Inc. service my computer, laptop, server or any other
network or electronic device that the customer is responsible for backing up
any data, software, information, pictures, e-mail, address books or media files
stored on the computer disk drives. I agree that whether or not I request backup
services from Above & Beyond IT, Inc. that Above & Beyond IT, Inc. or
any of its 3rd party service providers shall not be liable under any circumstances
for any loss of profit, data, software, information, files, compact discs, floppy
discs, DVDs or other media.
I agree that Above & Beyond IT technicians may repair all apparent defects unless otherwise requested, and may access files, information and/or other data on my personal computer, laptop, server or any other network or electronic device being serviced by Above & Beyond IT, Inc. Above & Beyond IT, Inc. and its technicians agree not to disclose to any other person (unless required by law) or use for personal gain any Confidential Information at any time unless Client grants express written consent of such a disclosure. In addition, Above & Beyond IT, Inc. will use their best efforts to prevent any such disclosure.
BILLING TERMS FOR SERVICE
All services provided by Above & Beyond IT,
Inc. are billed at an hourly rate. Charges will be calculated in quarter-hour
increments after the first hour. At your request we will provide you with an
estimate of cost for the work that you request us to do. Estimates are guaranteed
to 15% accuracy. In the case that we foresee a deviation on cost of job completion
beyond the above stated allowable amount, we will make every effort to contact
you and inform you of the situation and receive authorization to continue or
stop at the estimate limit. In the case we cannot reach you, we will continue
to work until the estimate limit is reached. Once reached, we will halt work
until contact is established.
PAYMENT TERMS
Full payment is due upon completion of service
unless credit has been granted previously by completing our credit application.
Failure to pay may result in the debt being turned over to a collections agency
and reporting to the credit bureau. You will be responsible for all costs incurred
by us, collection agencies, or courts incurred by litigation for failure to
pay.
UNCLAIMED GOOD POLICY FOR IN-HOUSE REPAIRS
When service or repair of my product is complete
Above & Beyond IT, Inc. will attempt to notify me to pick up my product.
I understand that this form must be present with me when picking up my completed
product. Above & Beyond IT, Inc. is not responsible for any product not
picked up within 30 days of the date the services were completed. In the event
that the product is not picked up within 30 days of completed work, Above &
Beyond IT, Inc. will dispose of the product by any means or method it may choose
at its sole discretion. Above & Beyond IT, Inc. cannot guarantee the confidentiality
of any information that may remain on unclaimed electronic storage devices,
including hard drives and computer disc drives. I agree that in the event I
fail to pick up my product after 30 days of the completion date, I thereby waive
and release all claims against Above & Beyond IT, Inc. related to such product
and its disposal.
RELATIONSHIP OF PARTIES
I agree that I will not solicit any Above &
Beyond IT, Inc. technician directly to perform work on my premises.
